If folks read up on the case it wasn't a freedom of speech issue.  By all accounts the owner was a bigot who was purposefully harassing and fired the employee because he was gay.  The courts ruled, correctly, that the laws at the time didn't prohibit this.  The laws being referenced protected folks because of race but not sexual orientation.
