They probably could, though depending on the five year old, their definition might not fit yours.  If I understand cotrrectly, though, the sorority didn't.  If they had said before allowing the plaintiff in that it was for  "people claiming to be female who don't have penises" or people born physically female, they might have had a better case or at least, forced teh judge to make a definitive ruling.
